Fifteen agriculture industry groups are now asking the courts to declare the 2015 Waters of the United States rule unlawful. The American Farm Bureau Federation says court briefs filed Friday in North Dakota support 13 state Attorneys General that also oppose the WOTUS rule.
The documents challenge the government’s jurisdiction in navigable waters, which AFBF says is vague and gives bureaucrats discretion to call certain land features like drainage ditches navigable.
