The National Pork Producers Council has defended the use of H-2A agricultural workers for constructing hog barns and similar facilities.
NPPC filed a brief with the U.S. Supreme Court in the Signet Builders versus Vanegas case, where Vanegas filed suit alleging that even though he was building hog barns, he wasn’t an agricultural employee for purposes of the Fair Labor Standards Act. NPPC believes that the construction of barns and other infrastructure is an essential and fundamental agricultural activity.
