South Dakota lawmakers are considering Senate Bill 117, introduced by Sen. Joshua Klumb, R-Mitchell, aimed at easing regulations for the state’s industrial hemp industry by aligning THC testing standards with federal guidelines.
The proposed amendment raises the threshold for retesting hemp samples from .3% to 1% delta-9 THC concentration, bringing it in line with USDA regulations. Supporters argue the change provides flexibility for farmers and processors, preventing unnecessary destruction of crops.
The bill also includes revisions to extend processor license validity, reduce background check frequency, and eliminate licensing requirements for possessing bales of industrial hemp.
The legislation awaits review by the Senate Agricultural and Natural Resources Committee.
