South Dakota Attorney General Marty Jackley has released a draft ballot explanation for a proposed amendment that aims to legalize recreational marijuana in the state.

If approved, the measure would permit individuals aged 21 and older to possess, grow, sell, ingest, and distribute marijuana and related paraphernalia, without impacting the existing laws regarding hemp or the state’s medical marijuana program.

The Attorney General remains neutral on the proposal, and the draft explanation serves to inform voters about the amendment’s purpose and potential effects.

Public comments on the draft will be accepted until August 21, with the final explanation due to the Secretary of State by August 31.
