The South Dakota Supreme Court has directed a lower court to reexamine a woman’s appeal concerning a dispute over pandemic benefits.
The case centers around Brittain Kovac, who was deemed ineligible for over $20,000 in unemployment assistance by the Department of Labor’s Reemployment Assistance Division.
Kovac’s appeal, initially rejected by the 6th district circuit court due to application errors, was challenged by the Division’s move to dismiss it as untimely.
The state Supreme Court recently ruled that the lower court made a mistake in its dismissal and emphasized that the appeal’s acknowledgment by the clerk of courts was adequate to meet the deadline.
The decision now requires the circuit court to reevaluate Kovac’s appeal.
