Summit Carbon Solutions Seeks Dismissal of South Dakota Landowners’ Appeal Over Pipeline Surveys

Summit Carbon Solutions, a company planning a multibillion-dollar carbon capture pipeline, has requested the South Dakota Supreme Court to dismiss an appealed survey access order made by landowners.

The landowners sought to prevent the company from accessing their land for surveys related to the Midwest Carbon Express pipeline.

Summit Carbon argues procedural errors in the appeal’s filing, claiming lack of notice in four out of five consolidated cases, preventing identification of appellants.

The appeal challenges whether South Dakota’s survey access law conflicts with the state constitution.

The company also faces challenges in obtaining permits for its pipeline project in various states along its route.
