City of Mitchell and nuisance property owner reach a settlement

It looks like the City of Mitchell and a local property owner have come to an agreement over a long-time nuisance property. The Mitchell City Council is set to consider approval of a settlement agreement between the city and David Finnell and Finnell Properties LLC regarding the building at 301 North Main at its next meeting Monday night.

Mayor Bob Everson says after months of negotiations the two sides came to an agreement. “He( Finnell) is signing over the building to the city of Mitchell,” said Everson. “So we can proceed hopefully with getting this thing taken down within a few months.” He says the city will pay for the demolition costs. Everson says the city has budgeted around $500,000 for the project.

Work on the building forced the closure of a portion of the 100 block of West Third in June of 2017 due to safety concerns. The City had filed a civil suit against Finnell and the LLC to resolve matters.

According to the agreement Finnell will turn over the property to the city for one-dollar plus past due property taxes of just under $2,400.

Finnell is responsible for the removal of personal property from the crumbling structure.

The agreement could be referred to a public vote.
