Circuit Court Judge Chris Giles denied a defense request Wednesday to suppress evidence in the trial of 50 year old Anthony Lewis of Mitchell. He’s accused of first and second degree murder in the stabbing death of Quinn Patrick Schleuning in August of 2017.
Lewis’s defense team asked the court to suppress statements he made to Police during an interview claiming the questioning should have ended once Lewis requested a lawyer.
However, Davison County prosecutors say when Lewis later recognized Lieutenant Don Everson, he agreed to resume the interview without a lawyer present saying he trusted Everson. Lewis also signed a Miranda card saying he understood his rights and agreed to waive them.
Giles cited several similar cases and denied the suppression request.
Lewis’s trial is set for mid-November. He remains in the Davison County Jail.
