A federal grand jury has indicted man and woman from Pierre for Conspiracy to Defraud the United States and related offenses.
51 year old Beth Miley, a/k/a Beth French and 54 year old Jason Miley, a/k/a Jake Miley were indicted in October and charged with Conspiracy to Defraud the United States, Conspiracy to Commit Bank Fraud, and Bank Fraud. Beth Miley is also charged with Theft of Government Funds and Social Security Fraud. They each pleaded not guilty to the charges.
The maximum penalty upon conviction is up to 30 years in federal prison and/or a $250,000 fine, three years of supervised release, and a $100 special assessment to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that Beth Miley concealed from the Social Security Administration the February 5, 2023, death of her husband, an SSA Title II Disability Insurance Beneficiary, so that she could continue to collect her deceased husband’s monthly SSA disability payments. The Indictment further alleges that between January 2024 and May 2026, Beth Miley and Jason Miley conspired to defraud the United States by fraudulently making monthly bank withdrawals of SSA disability payments from a bank account that was not held or owned by either of them.
Beth Miley and Jason Miley were released on bond pending trial. A trial date has been set for December 15th.
