37-year-old Andrew Nieman of Brookings has been sentenced to 10 years in the state penitentiary with five years suspended after pleading no contest to a charge of fourth-degree rape.
The offense, as per South Dakota statute, involves a victim aged younger than 16 but older than 13 and a perpetrator at least three years older than the victim.
In exchange for Nieman’s acknowledgment to the facts, five additional counts against him were dismissed by the state’s attorney’s office.
Nieman had to wait for sentencing until a psychosexual evaluation was performed, as required by state law.
He must register as a sex offender and refrain from any unsupervised contact with individuals under the age of 18.
