Davison County Sheriff’s Office Refers Squirrel Cruelty Case to Prosecutors

MITCHELL, S.D. — The Davison County Sheriff’s Office has completed its investigation into a Mitchell-area man’s alleged treatment of a squirrel and referred the case to the Davison County State’s Attorney’s Office for review.

The investigation began Thursday, Oct. 8, after the Mitchell Police Department became aware of a Facebook video depicting suspected animal cruelty. Police took an initial report before referring the case to the Sheriff’s Office and prosecutors.

The video allegedly shows Jonathan Wilson placing a caged squirrel into a tank of water. In the video, Wilson discusses trapping squirrels he says have been eating his apples and refers to giving the animal a “swimming lesson.”

Davison County Sheriff Steve Harr said his office completed the investigation and submitted its findings to prosecutors, who will determine whether South Dakota’s animal cruelty laws apply to the incident and whether criminal charges should be filed.

The video spread widely on social media, drawing public attention and prompting people to report it to law enforcement and wildlife officials.

No charges have been announced. The State’s Attorney’s Office will determine how to proceed with the case.
